Covenant Issues Process
Homeowners are encouraged to participate in our community by bringing covenant violation issues to the notice of the HOA Board.The board does not act as "police" by searching out covenant violations, but relies on the homeowners to bring violations and other concerns to the attention of the HOA board. As written in the Notice and Hearing and Enforcement Policy and Procedure, "the board of directors shall have the power and duty to hear and make decisions regarding violations and written complaints filed with the board, and impose fines or other sanctions, pursuant to the Policies and Procedures."
To Notify the HOA Board of covenant violation concerns, please follow these steps:
The complainant MUST first make reasonable attempts to discuss the complaint with the violator(s).
IF THE VIOLATION IS NOT RESOLVED AFTER DISCUSSING THE COMPLAINT WITH THE VIOLATOR, A written complaint MAY be submitted to the HOA Board. THE COMPLAINT IS REQUIRED TO include the following DETAILS:
The complainant's full name and address and be signed. Complaints must NOT be anonymous.
A statement of the details of complainant's attempts to discuss the complaint(s) with the violator(s). (Step 1)
A statement of the specific provision(s) of the Documents alleged to have been violated and as many specifics as are available as to time, date, location, and persons involved.
DELIVERING THE COMPLAINT IS ACCOMPLISHED BY THE FOLLOWING TWO METHODS:
Mailing to the HOA
Hand delivery to a board member
If possible, the complainant should attend the next HOA Board meeting following the submission of the complaint.
